He was the first openly gay man to be elected into public office in a seat on the San Francisco Board of Supervisors and passed a strict gay rights ordinance for the city, but was then assassinated by fellow supervisor Dan White.  Dan White’s case became famous when he used what is now termed the “Twinkie Defense.” That is, he claimed that he could not control his actions because of a severe depression he was experiencing, related to the overconsumption of sugary foods such as Twinkies. Thus, as opposed to first degree (double) murder as the evidence would suggest, Milk’s assassin, White, was convicted of voluntary manslaughter and only served 5 years in prison.
